is the allegation in the class action lawsuit filed by our firm on behalf of all AT&T wireless subscribers who have internet access
plans as part of their wireless service. Federal law bars wireless phone companies from including the internet access charges
portion of monthly wireless bills in the base against which state sales tax is charged. Yet, AT&T includes this portion
of the bill in the amount against which it charges subscribers for sales tax reimbursement, using the label "MI State
Telecom Surcharge" (for Michigan subscribers, and a similar label on the bill in other states).
